The Online School – Monthly Subscription Terms & Conditions

 

Terms and Conditions 

The company agrees to act in an ethical, diligent, prompt and professional manner with regard to The Online School Platform by the Customer, and onboarding to the platform as detailed on the front side of this contract.

 

LESSON PACKAGE:

The Company regularly provides upgrades and updates of the Learning Platform, the effect of which may require the Customer or the Student to upgrade its equipment at the Customer’s costs in order to make efficient use of the updated or upgraded Online Platform. For greater clarity, the Company will not be obligated to provide a Learning Platform that is compatible with any software platform or delivery mechanism except that for which the Online School Platform is offered by the Company.

The Online School. The Company agrees to use all reasonable commercial efforts to support the United Kingdom Curriculum for core subject (English, Maths and Sciences) otherwise specified on the front side of this agreement. 

The Company does not warrant that the use of the Learning Platform will be uninterrupted or error-free.

 

Conditions of Use.

The Learning Platform provided to the Customer is non-exclusive, non-transferable and are for the Customer’s Students’ personal use only. The Company may, but will not be obligated to, provide the parent of a Student with their own access to some or all of the Learning Platform from time to time at no further cost to the Customer. Customer’s right to use the Platform Services is conditional upon the following. Neither the Customer nor a Student may:

transfer to any other person any of its rights to use the Learning Platform;

sell, rent or lease the verified account or Leaning Platform;

make the Learning Platform available to anyone who is not a Student as set out on the front side of this Agreement.

A breach of the Conditions of Use by the Customer may terminate this Agreement and all monies paid or to be paid under this Agreement will be absolutely forfeited to the Company.

 

Customer Data (any electronic information stored in the Learning Platform database).

Customer is solely responsible for the content and accuracy of the Customer Data.

The Company must take commercially reasonable technical and organisational measures to keep personal data secure and to protect it against accidental loss or unlawful destruction, alteration, disclosure or access; and, must deal with the information only in accordance with Customer’s instructions, provided they are reasonable and lawful.

The Customer acknowledges and agrees that if the Customer or the Student wishes to retain any of the data, including any reports or lesson plans, produced by The Online School, it is their sole responsibility to do so and they may do so by printing that data, report or lesson plan.

 

Payments (Failure to Pay)

The Fees payable for the Lesson packages and tutoring services provided is payable as detailed in the Lesson Package Agreement. In the event the Customer does not pay any amount owing to the Company by the due date as stipulated in this Agreement, the Customer shall be in default under this Agreement. In the event of such default, until such default has been remedied by the Customer, the Company may suspend access to the Learning Platform without breaching this agreement. Furthermore, the Company may retain a collection agency or a legal representative for collection of the any outstanding amounts due under this agreement, and the Customer shall pay all collection costs incurred by the Company, including actual legal fees on an own client basis and the cost of any action commenced in a court of competent jurisdiction by Company to recover such amount.

 

Limitation of Liability.

The company shall not be liable under this agreement for any indirect, special, incidental, punitive or consequential damages or any other similar damages under any theory of liability (whether in contract, tort, strict liability or any other theory), even if the company has been informed of this possibility. Customer assumes all responsibility for the selection of the Learning Platform, necessary to achieve customer’s intended results, and for the use and results of the learning platform. The company’s total liability for any direct loss, cost, claim or, damages of any kind related to the agreement shall not exceed the amount of the fees paid or payable by customer to the company under this agreement, cost, claim or, damages. This limitation on liability was and is an express part of the bargain between the company and customer and was a controlling factor in the setting of the agreement price and any fees payable to the company. However, there is no limitation on direct loss, claim or, damages arising as a result of an infringement of the company’s intellectual property rights, or a breach of the conditions of use set out above or in connection with a party’s indemnification obligations as are specifically set out in this contract.

  

Uploaded Weekly Timetables:

You will receive a weekly email, and personalised lesson timetable for the upcoming week for each student. If for any reason you do not receive an email please a) Check your junk mail. b) contact The Online School through our webchat on our web page thonlineschool.uk. Please note: a weekly timetable can also be found when logging into the student account.

 

Cancellation Notice

United Kingdom Consumer Rights Act 2015

 Right to Cancel This Agreement within 14 Calendar Day Cooling Off-Period

You have the right to cancel this agreement without any reason within 14 calendar days from and including the day after you signed or received this agreement. You will not be entitled to a refund if you start using this service within this period or where we have planned in lessons and allocated resource. We will only partially refund monies paid where this has been the case.  

 

Extended Right to Cancel this Agreement

To cancel this agreement in writing, you are required to email the supplier.

Note: You, the Customer, MUST return to the supplier any goods supplied under the Agreement or arrange for the goods to be collected by the Supplier. Important Information about Your Cooling Off Rights Under The Consumer Rights Act 2015

 

Fourteen (14) Calendar Day Cooling Off Period

You may cancel the agreement at any time during the period that is 14 calendar days from the start of the cooling off period.

Any enrolment fee is not refundable and covers the expense incurred by The Online School in setting up the service.

If the agreement was negotiated by telephone, the cooling off period starts on the first day after you receive the written contract. Otherwise, the cooling-off period begins on the first day after you signed the contract.

 

How to Cool Off

You may exercise your right to cool off and terminate the agreement by completing the enclosed cooling-off notice and returning it to us. You may return the notice by:

Effect of Termination

If you elect to terminate the Agreement during the cooling-off period, the Agreement is treated as if it never existed.

If you require any additional information about your rights as a consumer and the cooling-off period, you should contact the Citizen’s Advice Bureau.

 

CREDIT USAGE

Once lessons have been scheduled on behalf of The Online School or by the student/parent credits will be deducted from the user’s account. No refund of credits/monies will not be honoured in the following circumstances;

 

1. Where a lesson has been booked for/by the student and not attended.  In the case of planned holiday or planned absence, we require at least 7 days written notice.  If this is not provided, credits for the appropriate lessons will be deducted.  

2. Any technical issue faced by the student, which includes internet/connection issues and device issues. (It is the Student/Parent’s responsibilities to ensure that their hardware and software is compatible for full access and features).

3. If students join late. The students will be required to catch up in their own time using the recorded lesson and not permitted to disturb the lesson (there maybe time at the end of the lesson to ask questions). 

5.Students should be respectful to teachers, any rude comments or bad behaviour can cost students credits or a permanent ban (depending on the situation)

6. Once the lesson is confirmed, bought or added into the bucket by student or parent and they cancel the class will only be entitled to a 20 min lesson recording max.

11. CREDIT RETURN POLICY

The company does not refund money used to purchase credit packages. However, credits may be returned back to an Online School user account if one of the following occurs:

 

A teacher cancels or does not show up for the scheduled lesson and where the company have not been able to cover.

Where a technical fault has occurred on the platform as a result of the software.

It is determined there is a technical issue with the video response.

It is determined the lesson was completed by someone other than the Teacher submitted to do so by The Online school.

A submission is declined for any reason.

If for any reason your account has been banned due to misuse or inappropriate behaviour on the platform. (see Behaviour Policy).

 

All credit return requests must be made in writing to info@theonlineschool.uk. Credit Return Requests will be processed automatically, and credits will be immediately returned back to a user account. For technical errors reported, The Online School will review the response within three (3) business days of receiving the request. If The Online School determines there is a technical error, credits will be returned to the user account.

BEHAVIOUR POLICY

Student Expectations, General behaviour 

Students are always expected to: 

Comply with the general behaviour expectations.

Be polite, well-mannered and respectful to all staff and fellow pupils 

Follow a teacher’s instruction and always follow instructions without debate 

Listen, be attentive, stay focused 

Never disrupt the learning of others 

Be mindful that there may be 30 of you and 1 teacher; patience is a virtue 

Know when to question things and when not to 

Be resilient if you make a mistake – do not give up 

Realise the importance of learning information  

Students must not: 

Cause offence to others, including the use of foul, racist or sexist language or inappropriate sexual remarks. 

Take any action which affects the health and well-being of others e.g. intimidating or offensive behaviour whilst using The Online School, including bullying. 

Bring The Online School’s name into disrepute. 

Threaten a student or adult. 

Bully another student; bullying of any sort will not be tolerated (verbal, emotional or cyber). 

Deliberately sabotaging The Online Schools resources or property. 

Bring any items into school which are not directly connected to their lessons. 

Get involved in any sort of buying and selling between students. 

 

The school reserves the right to involve the police in cases where students’ actions would be considered illegal if they happened outside the school. 

The school will always permanently exclude a pupil for the following: 

 

Supply or intent to supply illegal drugs in The Online School 

Abusing a member of staff or student

Serious misuse of social media that affects the health and well-being of a member of The Online School community or brings the schools name into disrepute. 

 

Other serious incidents may result in permanent exclusion or a fixed term exclusion up to 30 days. 

 

Permanent exclusion is a last resort for The Online School and all steps will be taken to avoid it.  However persistent failure to comply with the school’s Behaviour Policy may also lead to a permanent exclusion. 

 

Sanctions 

Failure to comply with the general behaviour expectations, may lead to sanctions being applied. These could be 

 

Verbal warnings  

De-merit

Removal of interaction privileges e.g. moved to a panellist, view only 

Removed from lesson by Moderator (Email to parents) 

Being placed on a monitoring

Withdrawal of Online School Privileges  

Exclusion, either fixed term or permanent 

 

10 sanctions could result in exclusion from The Online School. When parents are contacted to discuss their child’s progress, the Head Teacher will discuss positive steps can be taken to support their child and so they can avoid further sanctions. 

 Incidents and sanctions will be recorded on the school’s conduct data base and parents are notified by a text message or email on the day. 

 

School behaviour expectations  

The general school behaviour expectations already states that 

Students should not take any action which affects the health and well –being of others e.g. 

Offensive/abusive behaviour in the lesson and bullying

Any student who shows inappropriate images or sends/posts inappropriate images of one student to another would automatically receive a serious sanction by breaking the above rule. 

The school also takes very seriously the offence that a student commits when they take and share an inappropriate image of themselves as they are acting illegally and potentially affecting their own future well-being 

Any student who is found to have made, possessed or sent a sexually explicit image of themselves is acting illegally and would automatically expect to receive a serious sanction
